These Terms of Service (“Terms”) govern access to and use of the Pellerin dashboard platform (the “Dashboard”) operated by Pellerin Books Ltd (“Pellerin”, “we”, “us” or “our”).

By accessing or using the Dashboard, you agree to these Terms.

If you do not agree to these Terms, you must not access or use the Dashboard.

2. Eligibility & Access

The Dashboard is intended only for authorised users aged 18 or over.

Access may be provided to:

  • authors under contract with Pellerin;
  • authorised literary agents acting on behalf of authors, whose author client has provided us with their explicit written consent;
  • internal staff and investors of Pellerin.

Dashboard access is personal and must not be shared with any other person.

Users must not:

  • share login links or account access;
  • allow unauthorised third parties to access the Dashboard;
  • impersonate another user;
  • attempt to access information or accounts not intended for them.

We reserve the right to suspend or terminate access at any time where:

  • a publishing or working relationship ends;
  • these Terms are breached;
  • misuse is suspected; or
  • access is no longer required.

3. Dashboard Access & Security

The Dashboard uses a passwordless “magic link” login system.

Login links:

  • are single-use;
  • expire after a limited period of time; and
  • must be kept confidential.

You are responsible for maintaining the security of the email account associated with your Dashboard access.

If you believe your account or login access has been compromised, you should contact us immediately.

4. Purpose of the Dashboard

The Dashboard is designed to provide users with access to sales, marketing, production and related publishing information connected to titles published by Pellerin.

The Dashboard is intended as an informational and analytical tool only.

Nothing within the Dashboard constitutes:

  • financial advice;
  • investment advice;
  • accounting advice;
  • legal advice; or
  • a guarantee of future performance or results.

Any insights, analytics, indicators, trends or recommendations shown within the Dashboard are provided for informational purposes only and should not be relied upon as the sole basis for business, financial or marketing decisions.

5. Sales Data, Estimates & Reporting

The Dashboard includes data supplied by third-party retailers, distributors, advertising platforms, printers and data providers.

Some data displayed within the Dashboard may be:

  • estimated;
  • provisional;
  • delayed;
  • incomplete; or
  • subject to correction.

This includes, but is not limited to:

  • month-to-date sales figures;
  • estimated Kindle Unlimited revenue;
  • marketing attribution data;
  • advertising performance metrics; and
  • retailer reporting.

Figures shown within the Dashboard may change over time as updated reports and corrections are received.

The Dashboard is not an official royalty statement.

Official royalty statements remain the authoritative record for royalty payments and accounting purposes.

While we use reasonable efforts to ensure information is accurate and up to date, we do not guarantee the completeness, accuracy or uninterrupted availability of Dashboard data.

6. Marketing & Advertising Data

Marketing and advertising information displayed within the Dashboard is based on data supplied by third-party advertising and retail platforms.

Advertising metrics and attribution models may:

  • vary between platforms;
  • use estimated or inferred data;
  • change over time; or
  • contain overlapping attribution.

Advertising performance does not guarantee future sales performance.

Any campaign insights, efficiency indicators, performance classifications or opportunity signals displayed within the Dashboard are intended solely as informational tools.

Internal staff may use Dashboard insights as part of wider commercial decision-making processes, but Dashboard indicators are not automatically actioned and do not constitute guaranteed recommendations.

7. Assets & Downloadable Files

The Dashboard may provide access to downloadable assets, including:

  • marketing assets;
  • cover artwork;
  • social media assets;
  • ebook files;
  • audiobook files; and
  • production or distribution files.

Promotional and marketing assets may generally be used by authorised users in connection with the promotion of their titles.

However, ebook files, audiobook files, production files and other distribution materials are provided solely for authorised professional use and must not be:

  • redistributed publicly;
  • uploaded to third-party platforms;
  • sold;
  • shared widely; or
  • otherwise distributed beyond reasonable personal or professional use.

All intellectual property rights in Dashboard software, design, systems and materials owned by Pellerin remain the property of Pellerin Books Ltd or its licensors.

8. Acceptable Use

Users must not:

  • scrape or systematically extract Dashboard data;
  • reverse engineer or attempt to replicate the Dashboard;
  • copy, sell or commercially exploit Dashboard data or systems;
  • interfere with the operation or security of the Dashboard;
  • use automated tools, bots or scripts to access the Dashboard;
  • attempt to gain unauthorised access to restricted areas or accounts; or
  • use the Dashboard in any unlawful or harmful manner.

Users must also keep confidential any non-public information accessible through the Dashboard.

9. Availability & Changes

We use reasonable efforts to maintain Dashboard availability and functionality.

However, the Dashboard is provided on an “as available” basis and uninterrupted access is not guaranteed.

The Dashboard may occasionally be unavailable due to:

  • maintenance;
  • updates;
  • technical issues;
  • third-party platform failures; or
  • circumstances outside our control.

We reserve the right at any time to:

  • modify Dashboard features or functionality;
  • remove features;
  • change calculations, methodologies or reporting logic;
  • alter data sources;
  • suspend parts of the service; or
  • discontinue the Dashboard entirely.

10. Privacy

Your use of the Dashboard is also governed by our Privacy Policy.

11. Limitation of Liability

To the fullest extent permitted by law, Pellerin Books Ltd shall not be liable for:

  • any indirect or consequential loss;
  • loss of profits;
  • loss of business opportunity;
  • loss arising from reliance on Dashboard data;
  • inaccuracies or delays in third-party reporting;
  • interruptions to Dashboard availability; or
  • decisions made based on Dashboard insights, analytics or estimates.

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any liability that cannot legally be excluded under English law.

12. Termination

We may suspend or terminate Dashboard access immediately if:

  • these Terms are breached;
  • misuse is suspected;
  • access is shared improperly;
  • confidentiality obligations are breached; or
  • the relevant publishing or business relationship ends.

Upon termination, all rights to access and use the Dashboard cease immediately.

13. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted within the Dashboard or on our website.

Continued use of the Dashboard after updated Terms take effect constitutes acceptance of those changes.

14. Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any disputes arising in connection with these Terms or the Dashboard.
